ConfidentCar Terms of Use
Effective July 13, 2026.
1. Agreement to these terms
These terms are a binding agreement between you and ConfidentCar (“ConfidentCar,” “we,” “us”). By creating a packet, publishing a packet, submitting an inquiry, or otherwise using the service, you agree to these terms. If you do not agree, do not use the service.
2. What this service is
ConfidentCar is a documentation tool. It helps a private-party vehicle seller organize and present their own information (vehicle details, condition answers, disclosures, photos, maintenance records, and paperwork checklists) as a shareable packet page, and relays buyer inquiries to the seller.
3. What this service is not
ConfidentCar does not inspect, appraise, verify, certify, or warrant any vehicle or any statement made by a seller. It is not a marketplace and is not an escrow service. It does not hold or transfer funds, does not verify the identity of buyers or sellers, does not file paperwork with any government agency, and does not provide legal, tax, or financial advice. Checklists and document templates, including the bill of sale, are general information only and may not satisfy every state or transaction requirement. Confirm requirements with your state motor vehicle agency or an attorney.
4. Eligibility, accounts, and edit links
You must be at least 18 years old and able to form a binding contract to use the service. You are responsible for activity under your account and for keeping your sign-in secure. The service is intended for use in the United States.
You can use parts of the service without an account through a private edit link. Anyone with that link can view and edit the packet it points to; you are responsible for keeping the link confidential. We may associate a packet with an account if you later sign in.
5. Seller responsibilities
Sellers are solely responsible for the accuracy and completeness of everything in their packet, including condition ratings, disclosures, mileage, title and lien status, and uploaded documents. Publishing a packet is a representation by the seller to prospective buyers, not by ConfidentCar.
The service is for genuine, occasional private-party sellers. You may not use it for unlicensed dealing (“curbstoning”), for vehicles you do not have the right to sell, or to misrepresent a vehicle's condition, history, or title status. Required disclosures must be answered honestly.
6. Buyers
Information on packet pages is seller-provided unless explicitly marked otherwise. Buyers should independently verify condition, title, and history, including obtaining a professional inspection and their own vehicle-history report before paying any money. ConfidentCar is not a party to, and has no responsibility for, any transaction, payment, or communication between a buyer and a seller.
7. Fees and payment
Building a packet is free. Publishing a packet, which generates its shareable public link, may require a one-time fee where indicated in the service, shown to you at checkout before you pay. We may waive the fee during beta or promotional periods, and packets published during a waiver stay published at no charge.
Payments are processed by our payment provider (Stripe); ConfidentCar does not receive or store your full card details. Because you build and preview your complete packet before paying, you can see exactly what you are purchasing at the moment of payment. The fee is for the preparation and publishing service and is not contingent on selling your vehicle or on any buyer interest or transaction outcome.
8. Payments and refunds
Because you build and preview your complete packet before paying, and publishing happens the moment your payment goes through, the service is delivered in full at the time of purchase. For that reason the publishing fee is generally final; please review your packet before you pay. Beyond the situations described below, we do not offer refunds except where required by applicable law.
If something goes wrong on our side, we will make it right. If a technical failure prevents your packet from publishing or being accessible, contact support@confidentcar.app and we will fix the problem or refund the fee. If you believe a charge was made in error, please reach out before disputing it with your card issuer; we respond quickly, and chargebacks on a delivered service may lead to suspension of the account and removal of its published packets.
9. Your content and license
You keep ownership of the content you create and upload. You grant ConfidentCar a non-exclusive license to store, process, reproduce, and display your packet content for the purpose of operating and providing the service, including displaying your published packet publicly until you unpublish, archive, or delete it. Deleted content may persist in routine backups for a limited period. You represent that you have the rights to the content you upload and that it does not infringe anyone else's rights.
10. Acceptable use
You agree not to use the service for fraud, spam, scraping or automated data harvesting, harassment, uploading unlawful or infringing content, impersonation, or interference with or disruption of the service or its security. Accounts used for prohibited activity may be suspended or removed and their published packets taken offline, at our discretion.
11. Third-party services and links
The service relies on third-party providers to function and may link to third-party services (for example, vehicle-history reports, inspection, or transport providers), some of which may pay us a referral commission. Those links are offered as options for your convenience and independent verification; we do not control and are not responsible for third-party services, and your dealings with them are solely between you and that provider.
12. Service changes
We may modify features of the service as it evolves. If we discontinue the service or the hosting of published packets, we will make reasonable efforts to provide advance notice and a window to export your packet content.
13. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any packet will result in a sale.
14. Limitation of liability
To the maximum extent permitted by law, ConfidentCar will not be liable for disputes between buyers and sellers, for losses arising from any vehicle or its sale, or for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim.
15. Indemnification
You agree to indemnify and hold harmless ConfidentCar from any claims, losses, or expenses (including reasonable legal fees) arising out of your content, your use of the service, your sale or attempted sale of a vehicle, or your violation of these terms or of any law or of the rights of any third party.
16. Copyright complaints
If you believe content on the service infringes your copyright, send a notice to support@confidentcar.app identifying the work, the infringing material and its location, your contact information, and a statement of good-faith belief. We will review and remove infringing material as appropriate.
17. Governing law and disputes
These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in North Carolina will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there. Either party may instead bring an individual claim in small claims court in their own locality if it qualifies.
18. General
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms are the entire agreement between you and ConfidentCar about the service. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of the service. Our not enforcing a provision is not a waiver of it.
19. Changes and contact
We may update these terms; material changes will be reflected in the effective date above, and your continued use after a change means you accept the updated terms. Questions: support@confidentcar.app.
